Limit Increases in Online Gambling: What Operators Should Know Now

How a provider proves that a player can afford a deposit of more than 1,000 euros per month is currently the subject of several court proceedings. For operators, this raises less of a legal policy question and more of a practical one: How much proof should be kept on file as long as the legal situation remains unsettled?

The Statutory Framework

Section 6c of the Interstate Treaty on Gambling 2021 (Glücksspielstaatsvertrag 2021) limits deposits to 1,000 euros per month. This limit applies across all providers combined and is recorded via LUGAS. Higher limits are possible—up to 10,000 euros, and in exceptional cases up to 30,000 euros. To qualify, the player must prove that they can afford it, in a manner that allows the regulatory authority to verify the evidence.

The standard method for this is the SCHUFA-G query. It has been recognized for years, is fast, and is convenient for the player. Nothing about this has changed so far.

What Is Currently Happening in Court

On the regulatory side, the issue revolves around whether a credit check is sufficient as proof. An administrative court expressed doubts about this in August 2026, pointing out that the authority’s own guidelines actually require proof of income. This decision is provisional, the regulator is contesting it, and the final word has not yet been spoken.

On the civil side, it is about money. Players are suing for the reimbursement of their losses if they were able to deposit more than permitted. Two Higher Regional Courts (Oberlandesgerichte) have issued conflicting rulings on this—one in favor of the players, the other against. The Federal Court of Justice (Bundesgerichtshof) will clarify the issue. When that will happen remains open.

What This Means for Operators

From a regulatory perspective, nothing changes initially as long as administrative practice remains unchanged. The civil liability risk exists independently of this. Should the Federal Court of Justice rule in favor of the players, it will depend on which documents were available at the time of a limit increase and how they were documented.

The question is therefore not whether the SCHUFA-G query may continue to be used, but what additional proof makes sense. The answer varies depending on the portfolio. It depends on how many limit increases are granted, in what amounts, and what sums would be at stake in a dispute.
